Desire Joseph Mercier (1851-1926) was founder and first president of the Institute of Philosophy of the Catholic University of Leuven. After his studies in the classics, philosophy, and theology at the seminary of Mechelen, Mercier was ordained (1874), obtained a licentiate in theology at Leuven (1877), and became professor of philosophy at Mechelen the same year. In 1922 he was commissioned to inaugurate the chair of Thomistic philosophy created at the University of Leuven at the request of Pope (...) Leo XIII. Mercier endeavored to realize the program formulated in the encyclical Aeterni Patris (1879): to restore the philosophy of St. Thomas Aquinas, harmonize it with the progress of modern science and thought, and extend its influence to the scientific and social disciplines. On the basis of his initial success, he asked for, and received, the support of the Pope for the creation of an Institute of Philosophy that would provide a complete education in the various philosophical areas. When named president of this institute (1899), Mercier gathered collaborators from among his first students and with their assistance formed an international group of enthusiastic and devoted disciples. The Revue Neo-scolastique made the writings of the institute available throughout the scholarly world. On Feb. 7, 1906, Mercier was named archbishop of Mechelen. This monograph contributes to the scientific misconduct debate from an oblique perspective, by analysing seven novels devoted to this issue, namely: Arrowsmith by Sinclair Lewis (1925), The affair by C.P. Snow (1960), Cantor’s Dilemma by Carl Djerassi (1989), Perlmann’s Silence by Pascal Mercier (1995), Intuition by Allegra Goodman (2006), Solar by Ian McEwan (2010) and Derailment by Diederik Stapel (2012). Scientific misconduct, i.e. fabrication, falsification, plagiarism, but also other questionable research practices, have become a focus of concern for academic (...) communities worldwide, but also for managers, funders and publishers of research. The aforementioned novels offer intriguing windows into integrity challenges emerging in contemporary research practices. They are analysed from a continental philosophical perspective, providing a stage where various voices, positions and modes of discourse are mutually exposed to one another, so that they critically address and question one another. They force us to start from the admission that we do not really know what misconduct is. Subsequently, by providing case histories of misconduct, they address integrity challenges not only in terms of individual deviance but also in terms of systemic crisis, due to current transformations in the ways in which knowledge is produced. Rather than functioning as moral vignettes, the author argues that misconduct novels challenge us to reconsider some of the basic conceptual building blocks of integrity discourse. (shrink)

This paper briefly reviews highlights from decades of debates in medicine, law, bioethics, psychology and social research about children’s and parents’ views and consent to medical treatment and research. There appears to have been a rise and later a fall in respect for children’s views, illustrated among many examples by a recent book on the zone of parental discretion, which is reviewed. A return to greater respect for children’s views and consent is advocated.

This essay presents a critique of current views of Hugo Grotius which erroneously see him as a major theorist of natural rights and a formative influence upon the rights theory of Thomas Hobbes. Especially singled out for criticism are the misconceptions due to Richard Tuck in a number of writings that discuss the political ideas of Grotius and Hobbes and the relationship between them. In an examination of Hobbes's conception of natural rights, the essay reaffirms its originality and notes its (...) revolutionary potential contrary to the main intention of Hobbes's own political doctrine. An interrogation of the term 'theory' from the perspective of linguistic discourse Zima offers a new definition of theory from a cultural and sociological perspective, with a view to encountering heterogenerous points of view in critical dialogue.

A questionnaire on the attitudes towards the functions of research ethical committees was sent to members of selected research ethical committees in Wessex and some controls. Almost all respondents felt there was a need for ethical review of research projects; 42 per cent thought there was a need for some training before joining a committee; 67 per cent thought the system could be improved and 47 per cent thought that monitoring or follow-up procedures should be adopted. Ethical committees were thought (...) to be purely advisory, as opposed to mandatory, by 33 per cent, and 63 per cent thought they should restrict their review to ethical problems as opposed to scientific or design problems. Views about the function of non-medical members ranged from 'none at all' to 'very important'. Of the 10 controls who were asked whether they would become a member of an ethical committee if asked, seven said that on balance they would and the reasons stated varied from the view that it was a 'very important committee' to the feeling that it was 'a necessary but irksome job'. Justice Stephen J. Field was the champion of a form of liberalism often said to be especially friendly to capitalism, the approach to the Constitution traditionally identified with “Lochnerism,” i.e., a laissez-faire oriented judicial activism. More recently a form of judicial revisionism has arisen, challenging the accepted descriptions of “Lochnerism” and of Field's jurisprudence. This article is an attempt to extend the revisionist approach by arriving at a more satisfactory understanding of the grounding of Field's jurisprudence in the natural rights (...) philosophy. Field, it turns out, orienting around natural rights, was not so unambiguously friendly to capitalism as previous generations of scholars maintained, but his approach is surely friendlier than the constitutional theories that have replaced natural rights since Field's day. This paper explores the philosophical aspects of the "Great Introduction" of Abū Ma'šar, one of the great figures of Arabic astrology and an associate of al-Kindī, the great 9th century philosopher. I argue that the following points of philosophical interest may be found in this text: 1. Astrology is described as a "master science" along the lines proposed by Aristotle, i.e. it provides principles for lower sciences. Also he supplies arguments to ground astrology on methodological grounds, such as the use (...) of empirical evidence and testimony. 2. Abū Ma'šar broadly follows al-Kindī's explanation of how the stars influence the sublunary world, by heating the elements. This agrees with al-Kindī's work "On the Proximate Agent Cause of Generation and Corruption," and I identify some parallels between the two works. 3. Finally, Abū Ma'šarr considers whether human freedom is compatible with this causal account. He holds that human actions do fall under the class of the "possible" and not the "necessary," but only because for him the "possible" is what happens sometimes, not always. Thus he seems tacitly to hold that genuine choice is compatible with causal necessitation. (shrink)

Strawson has been a major and influential spokesman for ordinary language philosophy throughout the late twentieth century, studying the relationship between common language and the language of formal logic. This reissue of his collection of early essays, Logico-Linguistic Papers, is published with a brand new introduction by Professor Strawson but, apart from minor corrections to the text, these classic essays remain original and intact. Logico-Linguistic Papers contains Strawson's major essay, 'On Referring', in which he disputed Bertrand Russell's theory of (...) definite descriptions, distinguishing between referring to an entity and asserting its existence. The book contains twelve essays in all, grouped by subject matter. The first five are concerned with the topic of singular reference and predication and the last three are all responses to J.L. Austin's treatment of the topic of truth. Strawson disputes the correspondence theory of truth, maintaining that facts are what statements state.
